2. Services Provided

Tela Hosting Ltd. offers web hosting services, domain registration, and other related products. We provide various hosting plans, including Shared Hosting, WordPress Hosting, and Reseller Hosting. Additionally, we offer third-party services such as WHMCS Licenses, SSL Certificates, Digital Marketing, SEO, Web Development, Website Re-design, Logo Design, and Content Writing. All services are subject to availability and the specific terms outlined in our service agreements.

3. Account Registration

To use our services, you must create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you suspect any unauthorized access to your account, you must notify us immediately.

4. Payment and Billing

a. Billing Information

You agree to provide accurate billing information when registering for our services. All payments for services are due in advance and are non-refundable unless stated otherwise.

b. Payment Methods

We accept payments through various methods, including credit cards, bank transfers, and other online payment platforms.

c. Subscription Renewals

Unless you cancel your subscription before the end of your billing cycle, your service will automatically renew, and you will be billed for the renewal period.

d. Pricing and Changes

We reserve the right to change the pricing for our services at any time. We will notify you of any price changes prior to your renewal.

5. Web Hosting Terms

Our web hosting services are subject to the following terms:

a. Resource Limits

Each hosting plan comes with specific resource limits, such as bandwidth, storage, and email accounts. You agree to stay within these limits. If you exceed your allocated resources, we may charge you additional fees or require you to upgrade your hosting plan.

b. Hosting Service Availability

While we strive to maintain 99.9% uptime, we do not guarantee uninterrupted or error-free service. Our liability for service outages or interruptions is limited to the amount paid for the affected service during the 30 days preceding the outage.

c. Backup and Data Recovery

We provide backup services as part of certain hosting plans, but you are solely responsible for maintaining your own backups. We are not liable for the loss of data, including but not limited to email or website content.

d. Migration and Transfer

We provide free migration and transfers for only clients who have purchased our web hosting plan for a minimum of 1year billing cycle and not more than 2GB data/files/database/email size in total – If the account exceeds 2GB, it attracts extra ₦5000 ($3) per extra GB.

Note that, we only migrate the primary domain associated to the purchased hosting plan.

6. Domain Registration Terms

a. Domain Ownership

You retain ownership of your domain name as long as you continue to pay for it and comply with our Terms. If you fail to renew your domain, it may be suspended or deleted.

b. Domain Transfers

Domain transfers to and from our platform are subject to the domain registrar’s terms and conditions. We are not liable for any issues related to domain transfers, including delays, technical problems, or failures.

c. Domain Renewals

Domain renewals are your responsibility. Failure to renew your domain before expiration may result in the loss of ownership. We will send reminders for domain renewals, but we are not liable for missed renewals.

7. Third-Party Services Terms

We offer various third-party services, which are subject to separate terms and conditions provided by the respective third-party service providers. These services include:

a. WHMCS License

WHMCS licenses are provided by third-party providers. Any issues, support, or disputes related to WHMCS licenses must be directed to the appropriate provider, and their terms and conditions will apply.

b. SSL Certificates

SSL certificates are provided by third-party certificate authorities. These certificates are subject to the terms and conditions of the certificate issuer. Tela Hosting Ltd. is not responsible for any issues or failures related to SSL certificate issuance or installation.

c. Digital Marketing

Digital marketing services, including but not limited to search engine marketing (SEM), social media marketing, and paid advertising, are offered by third-party marketing agencies. These services are subject to the terms of the respective third-party agencies and providers.

d. SEO (Search Engine Optimization)

SEO services are provided by third-party companies, and their terms of service apply. Tela Hosting Ltd. is not responsible for the effectiveness or results of any SEO service provided.

e. Web Development

We offer web development services through third-party developers. Any web development services are subject to the terms and conditions of the respective developers.

f. Website Re-design

Website re-design services are provided by third-party service providers. These services are subject to the terms of the providers, and we do not guarantee specific outcomes or results from the redesign.

g. Logo Design

Logo design services are offered through third-party design professionals. These services are governed by the terms of the design professional or agency providing the logo.

h. Content Writing

Content writing services are provided by third-party writers or agencies. The terms and conditions of these third-party providers will govern your relationship with them.

By using any of these third-party services, you agree to be bound by the third-party provider’s terms and conditions. We are not responsible for any issues, claims, or disputes that arise from the use of third-party services.

8. Prohibited Activities

You agree not to use our services for any of the following activities:

a. Illegal Activities

  • Hosting, distributing, or promoting illegal content (e.g., pirated software, child exploitation material, etc.).
  • Engaging in fraud, hacking, or any form of illegal activity using our services.

b. Harmful Content

  • Hosting or distributing viruses, malware, or other harmful software that can damage or disrupt our systems or those of other users.

c. Spam

  • Sending unsolicited emails (spam) or participating in mass email distribution campaigns.
  • Using our servers to send unsolicited commercial communications.

d. Network Abuse

  • Engaging in excessive use of server resources that disrupts the normal functioning of our services.
  • Using our services to launch denial-of-service (DoS) attacks or any other activity that negatively impacts the performance or security of our network.

e. Violation of Intellectual Property

  • Hosting or distributing content that infringes on the intellectual property rights of others, including copyrights, trademarks, and patents.

f. Discrimination and Harassment

  • Using our services to harass, defame, or promote discrimination, hate speech, or violence against any individual or group based on race, religion, gender, sexual orientation, or other protected categories.

Failure to comply with these prohibited activities may result in immediate suspension or termination of your account without a refund.

9. Refund Policy

a. Web Hosting Refunds

We offer a 10-day money-back guarantee on our web hosting services, which means you can request a refund within 10 days of your purchase for Shared Hosting, WordPress Hosting, or Reseller Hosting. The refund is only applicable to the hosting service and excludes any additional services, such as domain registration, renewal, or third-party products.

  • Clients who have purchased any of our hosting services bundled with free domain or any other free service are not eligible for a full refund.
  • Our Unmanaged VPS are Non-Refundable once activated.

b. Domain Registrations, Renewals, and Transfers

Refunds are not applicable for domain registrations, renewals, or transfers. Once a domain is registered, renewed, or transferred, it is non-refundable, regardless of whether the domain is in use or not.

c. Third-Party Products

Refunds are not applicable for third-party products or services, such as WHMCS Licenses, SSL Certificates, Digital Marketing, SEO, Web Development, Website Re-design, Logo Design, and Content Writing.

d. Processing Refunds

  • Refunds will be processed within 30 days of receiving the request. We will issue the refund using the same payment method used for the original transaction.
  • All funds in the Wallet are non-refundable and can be used to make purchases for all eligible products and services.

10. Privacy and Data Protection

Your use of our services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to the practices outlined in our Privacy Policy.

11. Limitation of Liability

Tela Hosting Ltd. will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use or inability to use our services, including loss of data or business interruption. Our liability is limited to the amount you paid for the affected service during the 30 days preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tela Hosting Ltd., its officers, directors, employees, agents, and affiliates from and against any claims, losses, liabilities, damages, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

13. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Tela Hosting Ltd. or its licensors. You may not use, copy, reproduce, or distribute any of our intellectual property without our express written permission.
